Terms of service
Last updated 2026-10-08
These terms of service (general terms and conditions, in Hungarian “általános szerződési feltételek”) are the contract between zephyrmedia and every client who orders a publishing service through zephyrmedia.online. Please read them before you order. They apply together with the scope the studio approves for your request.
Terms printed in bold differ from what Hungarian law would provide by default or are otherwise important. When you confirm on the order page that you accept these terms and then pay (or request an invoice), you expressly accept these terms, including every term printed in bold. Nothing in these terms limits the rights that consumers have under mandatory law.
1. Who we are and who these terms apply to
The services are provided by the operator named below and in the Imprint (“zephyrmedia”, “we”, “us”). We are established in Hungary.
- Operator
- zephyrmedia
- Country of establishment
- Hungary
“You” or “the client” means the person who orders a service. You are a consumer if you are a natural person acting for purposes outside your trade, business, craft or profession. You are a business customer if you order for your trade, business or profession, or on behalf of a company or other organisation. Please tell us in your request if you order as a business. Some rules below apply only to consumers or only to business customers; where a rule does not say so, it applies to everyone.
You must be at least 18 years old to order. If you order on behalf of an organisation, you confirm that you are authorised to bind it.
2. The services
We publish YouTube Shorts. One publication means one Short published on one YouTube channel. You choose where your Shorts run:
2.1 On our network
We publish ready Shorts that you supply on YouTube channels that we operate, chosen by us within the niche agreed with you. We do not name these channels publicly; you see each publication through the links in your report. Channels on our network may share parts of their audiences. The plans are:
- Test run: $49 once. 10 ready Shorts × 3 channels = 30 publications. The test run is available once per client and never turns into a subscription by itself.
- Breeze: $149/mo. 20 ready Shorts × 4 channels = 80 publications per monthly billing period.
- Gale: $349/mo. 25 ready Shorts × 8 channels = 200 publications per monthly billing period.
- Storm: $699/mo. 30 ready Shorts × 15 channels = 450 publications per monthly billing period.
If you start a Breeze, Gale, Storm plan within 14 days of receiving your test-run report, $49 is taken off your first monthly payment. The credit applies once per client, cannot be paid out in cash and does not apply to own-channel publishing.
2.2 On your own channel
Your channel: $530/mo. We publish about one Short a day (about 30 a month) on your own YouTube channel, using the materials and schedule agreed with you. Any introductory price we quote to you applies as stated in your approved scope and at checkout. Own-channel publishing does not include publications on our network; you can order both.
2.3 What is not included
Editing, cutting or otherwise preparing videos is not included in any plan. If you need it, we agree and quote it separately before any work starts.
3. How the contract is made
- Request. You describe your channel, the plan you are interested in and your materials in the request form on the home page. A request is free and does not bind you or us.
- Review and approval. We check whether your channel and content fit (niche and audience) and tell you the result. If they fit, we approve a scope: the plan, the price and anything else agreed with you. You can follow this in the client portal. We may decline a request without giving reasons; no contract is made in that case.
- Order. Only an approved request can be paid. On the order page you see the plan, the price and the total including any applicable tax. You confirm that you accept these terms (and, as a consumer, the start of performance described in section 13), and then either pay by card in the embedded checkout or ask for an invoice. Before you pay or request the invoice, you can check every detail and correct it: go back, change the billing details in the checkout form, or contact us if the approved scope needs to change. Nothing is charged until you complete the payment step.
- Confirmation. We confirm your order by email without undue delay: with a payment confirmation when you pay by card, or with the Stripe invoice sent to you when you choose invoice payment. If you do not receive this confirmation within 48 hours of your order, you are no longer bound by your order.
The test run is a one-time service. A monthly plan runs for an indefinite period, billed monthly, until you or we end it as described in section 9; there is no minimum term. We do not ask for a deposit or any other financial guarantee.
The contract is concluded when we send that confirmation. It is concluded electronically. It is not a written contract under Hungarian law, and we do not file it as a separate document. We keep a record of your request, the approved scope, the version of these terms you accepted and your payment, and you can see your requests in the client portal. These terms remain available on this page. The contract language is English. We have not signed up to any code of conduct.
If an individually agreed term in your approved scope differs from these terms, the individually agreed term prevails.
4. After payment: audience check and start
After we have verified your payment with our payment provider, we check the channel audience once more before anything is published. Publishing starts only after this approval, on the schedule agreed with you. If we do not approve publishing at this stage, the contract ends and we refund everything you paid within 14 days, to the payment method you used.
5. Your obligations and materials
- You supply the agreed Shorts and information on time. You must own, or have all the licences and permissions needed for, everything in the materials you supply (video, music, footage, voices, trademarks and the people shown), for publication on YouTube in the way agreed.
- Your materials must comply with our content and acceptable use policy, the law and YouTube’s rules.
- For own-channel publishing, you grant our account the YouTube Studio permissions we agree with you. We never ask for your password, and you must not send it to us. You can remove our access in YouTube Studio at any time; we cannot publish on your channel without it.
- You give us accurate contact and billing details and keep them up to date.
If you supply fewer Shorts than your plan covers in a billing period, or supply them late, we publish what you supply in time. The price for that period is not reduced, and unused publications do not carry over, unless we agree otherwise in writing. Delays caused by missing materials or permissions do not count against our deadlines.
6. Publishing and reports
We publish your Shorts on the agreed channels and schedule, with the titles, descriptions, hashtags and creator credits agreed with you. You receive reports with the links to each publication and the views recorded at the time of the report: at the end of the test run, and for monthly plans at least once per billing period. The status of your request is shown in the client portal.
We do not use bots, bought views or any other artificial engagement. Publications reach the real audiences of the channels concerned.
7. Labelling of paid promotion
Publications on our network are made because you pay us, so they are commercial communications. We label them as paid promotion, using YouTube’s “includes paid promotion” disclosure and any other label the law or YouTube’s rules require. On your own channel, tell us when a Short contains paid promotion, sponsorship or a product you were given, so that we can disclose it. You must not ask us to hide or remove such a label. Details are in the content policy.
8. Prices, tax and payment
- Prices are in US dollars (USD). The plan prices are listed in section 2 and on the pricing page. The price that applies to you is the one shown at checkout for your approved scope.
- Any applicable tax (such as VAT) is calculated from your billing location. The total amount you pay, including any tax, is shown before you pay.
- Payments are processed by Stripe. You can pay by card in the embedded checkout, or ask for an invoice that Stripe emails to you, payable by bank transfer or card within 7 days. We never see or store your full card details.
- A test run is paid in advance once. Monthly plans are paid in advance for each monthly billing period.
- Charges for currency conversion or international payments made by your bank or card issuer are your own.
- Unless these terms say otherwise, any refund we owe you is paid without undue delay and at the latest within 14 days of the day the refund became due, to the payment method you used, unless you expressly agree to another method. You pay no fee for a refund.
- If an invoice is not paid by its due date, we may cancel the order. If a payment for a monthly plan fails, we pause publishing until it is paid, and if it remains unpaid we may end the subscription after telling you by email. Publications that are paused because of non-payment are not owed later.
9. Monthly plans: renewal, cancellation and plan changes
A monthly plan renews automatically every month, and the price is charged in advance for each new billing period, until you cancel. You can cancel at any time in the billing page (“Manage billing” in the client portal) or by asking us via contact@zephyrmedia.online. Cancellation takes effect at the end of the billing period you have already paid for; that period is not refunded and we complete its publications. This does not affect the consumer’s right of withdrawal (section 13), any right the law gives you to end the contract with immediate effect (in which case you pay for what we performed until then and we refund any prepaid amount for the rest, as the law provides), or refunds owed because we failed to perform.
You can switch between Breeze, Gale, Storm on the billing page. The change applies at once, and Stripe calculates a prorated charge or credit for the rest of the current period. Other changes, such as adding own-channel publishing, are made by agreement with us.
We may end a monthly plan for any reason by notifying you at least 30 days before the end of a billing period. In that case the plan ends at the end of that billing period.
10. Test-run guarantee and credit
We publish all 30 test publications (10 Shorts × 3 channels) within 7 days. The 7 days start when both your payment has been received and we have received and approved your 10 Shorts. If not all 30 publications are live within that window, we refund the full $49 (plus any tax you paid on it), unless the shortfall was caused by you (for example because Shorts were missing, late, replaced during the window, or rejected under the content policy). How to claim and when we pay is set out on the refunds page. For business customers, this refund is the only remedy for a missed test-run window. For consumers it is an extra guarantee and does not replace their statutory rights.
The test-run credit towards a monthly plan is described in section 2.1.
11. No guaranteed results
We owe the agreed publications and reports, not a particular outcome. We do not promise or guarantee any number of views, clicks, likes, comments, subscribers, watch time, sales or revenue, or that any Short will be recommended by YouTube. Figures in reports are those recorded by YouTube at the time of the report and can change later.
12. YouTube and platform risk
We are independent of YouTube and Google and are not endorsed by them. YouTube decides on its own rules, its recommendation systems and what it allows on its platform. YouTube may at any time remove, restrict, age-restrict, demonetise or limit the reach of content or channels, suspend accounts or change its features, policies or algorithms. We are not responsible for such platform decisions or their effects, unless they were caused by our own breach of contract. If a platform decision prevents a publication that we owe you, we re-publish on another suitable channel where possible; if we cannot, you do not pay for that publication and we refund its proportional price, or credit it against your next billing period if you prefer.
13. Consumers’ right of withdrawal
If you are a consumer, you can withdraw from the contract within 14 days of its conclusion without giving reasons. If you expressly ask us to start publishing within those 14 days, you pay a proportional amount for what we performed before you withdraw, and you lose the right of withdrawal once the service has been fully performed. The details, how to withdraw and a model withdrawal form are on the refunds and right of withdrawal page, which forms part of these terms. Business customers have no statutory right of withdrawal.
14. Our right to refuse or stop publishing
We may refuse to publish, pause or remove any Short that we reasonably believe breaks the content policy, the law, third-party rights or YouTube’s rules, or that is the subject of a well-founded complaint by a rights holder or a request from YouTube or an authority. We tell you about it and why, unless the law or an authority prevents us. If you supply a replacement Short in time, we publish it instead. Otherwise, a publication refused or removed because your material breaks the content policy, the law, third-party rights or YouTube’s rules is not refunded. If we refuse a Short only because of channel fit, and not because of a problem with it, you can replace it; if you do not, we refund the proportional price of that publication.
15. Rights in your Shorts
You keep ownership of all rights in the Shorts and materials you supply; nothing in this contract transfers them to us. You grant us a non-exclusive, worldwide, royalty-free licence (the price covers it) to copy, upload, publish and make your Shorts available to the public on YouTube on the agreed channels, and to add the agreed titles, descriptions, hashtags and credits and any disclosure the law or YouTube requires, for the purpose of providing the service and for the term of the contract. We do not use your Shorts for our own marketing without your separate consent.
When the contract ends, publications already made on our network may stay online, and the licence continues for them, unless you ask us to remove them. You can ask at any time via contact@zephyrmedia.online; we remove the publications you list without undue delay and at the latest within 14 days of your request, and tell you when it is done. The same applies during the contract (see the content policy). On your own channel the Shorts are under your control, and you can remove our YouTube Studio access when the contract ends.
16. Responsibility for your content
You are responsible for the Shorts and information you supply. Our review checks fit and obvious problems; it is not legal clearance of your content.
If you are a business customer, you indemnify us against claims, losses, fines and reasonable legal costs arising from a claim by a third party (including a rights holder, YouTube or an authority) that your materials infringe their rights or break the law, unless we caused the problem. We tell you promptly about such a claim and let you take part in the defence.
If you are a consumer, you are liable for damage caused by your breach of these terms (for example supplying material you had no right to supply) under the general rules of Hungarian law, and only to the extent the law allows.
17. Our liability
We are liable for damage caused by breaching the contract in accordance with Hungarian law. We are not liable if the breach was caused by circumstances outside our control that we could not foresee when the contract was made and could not reasonably avoid (section 19).
If you are a business customer, our total liability arising from or in connection with the contract is limited to the fees you paid us in the 3 months before the event that caused the damage, and we are not liable for lost profit, lost revenue, loss of channel monetisation or other indirect or consequential loss.
These limits do not apply to damage caused intentionally or by gross negligence, to damage to life, physical integrity or health, or to any other liability that cannot be limited under Hungarian law (Civil Code section 6:152).
If you are a consumer, we do not limit or exclude our liability towards you beyond what Hungarian law itself provides, and nothing in these terms affects your mandatory rights.
18. Defective performance (warranty)
If a service we provide is defective (for example a publication is missing, made on the wrong channel, or does not match the agreed details), tell us without undue delay after you notice it. You can ask us to re-perform it (for example publish it again correctly). If we refuse, cannot do it within a reasonable time without significant inconvenience to you, or your interest in re-performance has ended, you can ask for a proportional price reduction, have the defect remedied by someone else at our cost or, unless the defect is minor, end the contract and get the price of the defective part back. You may switch from one remedy to another, but you bear the cost of switching unless it was justified or we gave you reason for it.
If you are a consumer, these are your statutory warranty rights (“kellékszavatosság”): a notice given within two months of discovering the defect is in time, and your claim expires two years after performance. If you are a business customer, you must notify us of a defect within 15 days of the report that shows it, and your warranty claim expires one year after performance.
19. Force majeure
Neither party is liable for a delay or failure caused by events outside its reasonable control that it could not foresee or avoid, such as natural disasters, war, epidemics, official measures, or widespread outages of YouTube, payment or hosting providers. The affected party tells the other without undue delay. Deadlines are extended by the time the event lasts. If it lasts more than 30 days, either party may end the affected contract, and we refund the price of services not yet performed.
20. Suspension and termination for breach
If you seriously breach the contract (for example by supplying material that infringes third-party rights or the content policy, asking us to hide paid-promotion labels, buying fake engagement, or reversing a payment without reason), we may suspend publishing or end the contract with immediate effect by email. For a breach that can be remedied, we first give you a reasonable deadline to remedy it. If we end the contract this way, we refund the price of publications not yet made in the paid period, subject to any claim we have against you under the law.
You may end the contract with immediate effect if we seriously breach it and do not remedy the breach within a reasonable deadline you give us. We then refund the price of services not yet performed.
21. AI helper and AI-assistant connection
The AI helper on the home page suggests services based on what you type. Its suggestions are generated automatically by an AI model, may be wrong or incomplete, and are not an offer or advice. Only the scope approved by the studio and shown at checkout is binding.
If you are signed in, you can connect an AI assistant of your choice to your account. It then acts with your permissions and can read your own plans and requests. You choose and control that assistant and can disconnect it at any time. We are not responsible for how a third-party assistant uses the information you let it read or for what it tells you. What it does on your behalf counts as done by you.
22. Personal data
We process personal data as described in the privacy policy and the cookies page.
23. Changes to these terms
A one-time order is governed by the version of these terms you accepted. We may change these terms, including the price of a monthly plan, for future billing periods of a running subscription if there is a valid reason: a change in the law, a decision of an authority or court, a change in YouTube’s or a payment provider’s rules that affects the service, or a lasting increase in the costs of providing the service. We tell you about the change, and the reason for it, by email at least 30 days before it takes effect. The change applies from the first billing period that starts after that date. If you do not agree, you can cancel before then at no cost, and the old terms apply until the end of your paid period. Changes never apply to periods you have already paid for.
24. Complaints and disputes
You can complain to us by email at contact@zephyrmedia.online. We answer a complaint in writing, with reasons, within 30 days. If you are a consumer and we cannot settle the dispute, you can turn to a Hungarian conciliation board (békéltető testület), the consumer protection authority or a court. Details are on the complaints and disputes page.
25. Governing law and courts
The contract is governed by Hungarian law. If you are a consumer living in another country, you also keep the protection of the mandatory consumer law of the country where you live, and you can bring proceedings in the courts that have jurisdiction under the applicable rules, including the courts where you live within the EU.
For business customers, the Hungarian court having jurisdiction for our seat (place of establishment, shown in the Imprint) has exclusive jurisdiction.
26. Other provisions
- If any provision of these terms is invalid or unenforceable, the rest remain in effect, and the invalid provision is replaced by the applicable statutory rule.
- If we do not enforce a right at once, we have not waived it. A waiver must be made in writing (email is enough).
- We may use subcontractors and service providers to perform the contract; we remain responsible for them as the law provides.
- Notices under the contract are given by email to the address you used for your request or that we published.
- Claims under the contract expire after five years unless the law provides a shorter period (see section 18 for warranty claims).
27. Contact
